TERMS & CONDITIONS

1. General

Welcome to House of Emra. By accessing houseofemra.com ("the
Website") and purchasing our products, you ("the Customer")
agree to these Terms & Conditions ("Terms"). These Terms apply to
all users of the Website and govern every purchase contract concluded with
House of Emra.

The contractual partner is House of Emra, Heimstrasse, 8953 Dietikon,
Switzerland. Contact: hello@houseofemra.com.

2. Offer and Conclusion of Contract

The presentation of products on the Website does not constitute a
legally binding offer, but an invitation to the Customer to place an order. By
clicking the order button, the Customer places a binding order for the goods in
the shopping cart. A purchase contract is concluded upon our sending an order
confirmation by email or upon dispatch of the goods, whichever occurs first.

3. Made-to-Order Production

Every House of Emra item is produced individually after order placement,
based on the Customer's specifications (including but not limited to size,
colour, and variant selection). No
stock is held. This means:

  • Production begins shortly after your order is placed
    and cannot be reversed once started.
  • Each piece is uniquely associated with your order and
    cannot be resold.
  • For this reason, the statutory exception for
    custom-made and personalised goods applies to our products (see Section 6).
  • Production lead times are communicated during checkout and in your order
    confirmation.

4. Prices, Shipping and Taxes

All prices include Swiss statutory value-added tax (VAT), where
applicable. Shipping costs are additional and are clearly displayed on the
product page, in the shopping cart, and at checkout before the order is
finalised.

Customs duties and import taxes (EU, UK, USA, Canada, Australia and rest
of world): Any customs fees, import duties, or additional taxes
imposed by the destination country are not included in the product price
and are the sole responsibility of the Customer. Customers can estimate
potential duties at simplyduty.com.

We ship orders once per month. Delivery within the EU typically takes
3–5 business days from the dispatch date, which is confirmed via email. Actual
transit times outside the EU may vary.

5. Payment and Retention of Title

Payments may be made by credit card, PayPal, or other payment methods
offered at checkout. We reserve the right to restrict available payment methods
in individual cases. All goods remain the exclusive property of House of Emra
until full payment of the purchase price and any shipping costs has been
received.

6. Cancellations and Order Changes

Cancellation window (within 24 hours): Orders may be
cancelled free of charge within 24 hours of order placement by emailing
hello@houseofemra.com. After this period, production preparations begin and the
order can no longer be cancelled free of charge.

Cancellation after 24 hours, before dispatch: At
our sole discretion, we may accept a cancellation request after the 24-hour
window but prior to dispatch. In such cases we will issue a store credit
for the full order value, less any shipping or handling costs already incurred.
A cash refund will not be issued for discretionary cancellations.

Cancellation after dispatch: Once an order
has been dispatched, it can no longer be cancelled. The provisions on refused
deliveries (Section 8) shall apply if the parcel is not accepted.

7. Returns, Refunds and Store Credit

No returns or refunds for change of mind. Because every
House of Emra piece is individually made to the Customer's specifications, we do
not accept returns, exchanges or refunds for reasons including, but not
limited to: change of mind, sizing preference after receipt, colour preference,
style change, or unwanted gifts. This policy reflects Article 16(c) of EU
Directive 2011/83/EU (exception from the right of withdrawal for goods made to
consumer specifications or clearly personalised) and is consistent with Swiss
contract law.

Damaged or defective items: If your item
arrives damaged or is defective on arrival, you must notify us within 7 days
of delivery by emailing hello@houseofemra.com with (i) photos clearly
showing the damage or defect and (ii) a written description. We will, at our
choice, either replace the item at no cost to you or issue a store credit of
equivalent value. This does not affect your statutory warranty rights for
material defects.

Store credit terms: Store credits issued by House of Emra (whether for
discretionary cancellations, refused deliveries, damaged items, or goodwill)
are valid for 24 months from the date of issue, are personal to the
Customer, are non-transferable, and cannot be exchanged for cash. Store
credits may be applied toward any purchase on houseofemra.com during the
validity period. Unused store credits expire at the end of the 24-month period
without further notice.

8. Refused or Unclaimed Deliveries

If the Customer refuses to accept a delivered parcel, fails to collect
it from the carrier within the carrier's holding period, or the parcel is
returned to us because the Customer provided an incorrect or incomplete
address, the following applies:

  • The Customer is responsible for the original shipping
    cost, the return shipping cost, and a handling fee of CHF 15.

  • If the Customer still wishes to receive the item,
    re-shipment will occur only after payment of a new shipping fee.

  • If the Customer no longer wishes to receive the item,
    House of Emra will issue a store credit for the product value, less the costs
    listed above. No cash refund will be issued in this case, as the underlying
    cancellation is at the Customer's discretion.

9. Information for Consumers in the European Union

Exclusion of the right of withdrawal. Under Article
16(c) of EU Directive 2011/83/EU and corresponding national implementations,
the 14-day right of withdrawal does not apply to the supply of goods
that are made to the consumer's specifications or are clearly personalised. All
House of Emra products fall within this exception, as every item is produced
individually based on the Customer's specifications (size, colour, variant).
The Customer acknowledges and accepts this exclusion at the time of placing the
order.

Online Dispute Resolution (ODR). The European
Commission provides a platform for online dispute resolution, available at
https://ec.europa.eu/consumers/odr. Our email for complaints is
hello@houseofemra.com. We are not willing or obliged to participate in dispute
resolution proceedings before a consumer arbitration board.

10. Warranty and Liability for Defects

The statutory provisions on liability for material defects apply.
Obvious defects must be reported in writing within 14 days of delivery; hidden
defects must be reported immediately upon discovery. Minor variations in
colour, texture, or finish due to the handmade nature of our products, or minor
display and lighting differences between product images and the delivered item,
do not constitute a defect.

11. Liability

House of Emra is liable without limitation for damages caused by intent
or gross negligence, for injury to life, body or health caused by House of
Emra, its legal representatives or vicarious agents, and for damages falling
under mandatory product liability law. Liability for slight negligence is
limited to damages that were reasonably foreseeable at the time of contract
conclusion. Any further liability is excluded to the extent permitted by law.

12. Force Majeure

House of Emra is not liable for delays or failures in performance caused
by events beyond our reasonable control, including but not limited to strikes,
transport disruptions, carrier delays, raw-material shortages, epidemics,
pandemics, natural disasters, acts of state, or war. Affected delivery
deadlines are extended by the duration of the disruption.

13. Intellectual Property

All content on this Website, including but not limited to text, images,
graphics, logos, photographs, product designs, and layouts, is the property of
House of Emra and is protected by copyright and other intellectual property
laws. Any use, reproduction, modification, or distribution of this content
without the prior written consent of House of Emra is strictly prohibited,
including for commercial purposes.

14. Data Protection

House of Emra processes personal data in accordance with the Swiss
Federal Act on Data Protection (FADP/revFADP) and, where applicable, the EU
General Data Protection Regulation (GDPR). Details on the collection, use, and
storage of personal data are set out in our separate Privacy Policy, which
forms an integral part of these Terms.

15. External Links

The Website may contain links to third-party websites over which we have
no control. House of Emra accepts no responsibility for the content, accuracy,
or legality of such external sites. Upon first linking, the linked content was
reviewed for legal violations and none were identified. Continuous monitoring
is not reasonable without concrete indications of unlawful content. If we
become aware of legal violations, we will remove the corresponding links
without delay.

16. Amendments to the Terms

House of Emra reserves the right to amend these Terms at any time. The
version in force at the time of order placement applies to that order. The
current version is always available on the Website.

17. Severability

Should any provision of these Terms be or become invalid or
unenforceable, the remaining provisions shall remain unaffected. The invalid or
unenforceable provision shall be replaced by a valid provision that comes
closest to the economic intent of the original provision.

18. Governing Law and Jurisdiction

These Terms and any contract concluded on their basis are governed by
the substantive laws of Switzerland, excluding the United Nations
Convention on Contracts for the International Sale of Goods (CISG) and
excluding Swiss conflict-of-laws rules. The exclusive place of jurisdiction for
all disputes is Zurich, Switzerland. Mandatory consumer protection
provisions of the consumer's country of habitual residence (within the EU)
remain unaffected.

1. Content and Liability

The content on this Website is created with the utmost care. However,
House of Emra does not warrant the accuracy, completeness, or timeliness of the
information provided. Liability claims for material or immaterial damages
caused by the use or non-use of the information provided, or by the use of
incorrect or incomplete information, are excluded unless proven to be the
result of intentional or grossly negligent conduct by House of Emra.

2. Product Images

Due to display settings, lighting conditions, and the handmade nature of
our products, minor discrepancies between product images and the actual item
delivered may occur. Such minor discrepancies do not constitute a defect.

3. Intellectual Property

All materials on this Website are protected by copyright. See Section 13
of the Terms.

4. Jurisdiction

Swiss law applies. The exclusive place of jurisdiction is Zurich,
Switzerland.
